We do not make decisions based solely on automated processing, including profiling, that have legal or similarly significant effects on you.
Promotional offers from us
We may use your personal data to form a view on what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you.
You will receive such marketing communications from us if you have requested information from us, have engaged in a professional or business relationship with us, or purchased goods or services from us, and you have not opted out of receiving that marketing. Where you are an existing customer or have enquired about our products or services, we rely on the soft opt-in under the Swedish Marketing Act (marknadsföringslagen (2008:486)) and the ePrivacy Directive. Where we have no such prior relationship with you, we will obtain your consent before sending you marketing. You may opt out of marketing at any time through the unsubscribe link in each email or by contacting us.
Third-party marketing
We will get your express opt-in consent before we share your personal data with any third party for marketing purposes.
Sales of personal data
We do not sell personal data. If personal data is transferred in connection with a merger, acquisition or sale of shares, business or assets, the new owner may use it in the same way as set out in this policy.
Opting out
You can ask us or third parties to stop sending you marketing messages at any time by contacting us at any time.
Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of account management, product/service experiences, and other transactions.
Change of purpose
We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us.

We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.
6. INTERNATIONAL TRANSFERS
Some of our external third parties are based outside the European Economic Area (EEA) so their processing of your personal data will involve a transfer of data outside the EEA. We store most data in the EU [confirm hosting regions]. Providers that are US companies, such as Google, Amazon Web Services, GitHub, HubSpot, WorkOS, Resend and Anthropic, may process or access data in the US.
Whenever we transfer your personal data out of the EEA, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:
- subject to the points below, we will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data by the European Commission.
- where we use certain service providers, we may use the Standard Contractual Clauses approved by the European Commission (Commission Implementing Decision (EU) 2021/914), which give personal data the same protection it has in Europe.
- where we use providers based in the US, we may transfer data to them if they are certified under the EU-US Data Privacy Framework or other mechanism which requires them to provide similar protection to personal data shared between Europe and the US.
- where required, we carry out a transfer impact assessment to evaluate the legal framework of the recipient country and apply supplementary technical measures, such as encryption in transit and at rest, and organisational measures, so that your personal data has an essentially equivalent level of protection.
Please contact us if you want further information on the specific mechanism used by us when transferring your personal data out of the EEA.
7. DATA SECURITY
We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way, altered, or disclosed. These measures include encryption of personal data in transit and at rest, role-based access controls, logging and monitoring, regular security assessments and vulnerability testing, and security training for our staff. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions, and they are subject to a duty of confidentiality.
We have put in place procedures to deal with any suspected personal data breach. Where a breach is likely to result in a risk to your rights and freedoms, we will notify the supervisory authority within 72 hours of becoming aware of it, in accordance with Article 33 of the GDPR. Where a breach is likely to result in a high risk to your rights and freedoms, we will also notify you directly without undue delay, in accordance with Article 34.
8. DATA RETENTION
We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation.
To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, or other requirements.
Our usual retention periods are:
- Account Data: while your account is open and for 12 months after it closes.
- Content Data: until you delete it or your account closes. After closing, you can export it for 30 days; we then delete it. Backups are deleted within 35 days.
- “Try it on device” inputs and outputs: deleted within 24 hours; technical logs without the content are kept for 30 days.
- Waitlist: until 12 months after the service opens, or until you unsubscribe.
- Marketing data: until you unsubscribe or withdraw consent; we then keep your email address on a suppression list so that we do not contact you again.
- Analytics data and session recordings: 12 months for analytics data and 30 days for session recordings.
- Hugging Face Access Data: while your access is active and for 24 months after.
- Billing records: seven years after the end of the financial year, as the Swedish Bookkeeping Act requires.
- Security logs: 90 days, or longer if needed to investigate an incident.
The retention periods above apply to personal data we process as a data controller. Retention and deletion of data we process as a processor on behalf of an organisation using Embedl Hub are governed by our data processing agreement and the applicable customer agreement.
9. YOUR LEGAL RIGHTS
You have rights under data protection laws in relation to your personal data. You have the right to:
a) request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.
b) request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
c) request erasure or deletion of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. However, please note that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.
d) object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.
e) request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:
- to establish the data’s accuracy.
- where our use of the data is unlawful, but you do not want us to erase it.
- where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims.
- you have objected to our use of your data, but we need to verify whether we have overriding legitimate grounds to use it.
f) request the transfer of your personal data to you or to a third party. This right applies where we process the data on the basis of your consent or a contract and the processing is carried out by automated means. We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format.
g) withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you or otherwise continue our relationship. We will advise you if this is the case at the time you withdraw your consent. You can withdraw consent to cookies at any time through “Cookie settings”, and to marketing through the unsubscribe link in each email.
h) lodge a complaint with a supervisory authority if you consider that our processing of your personal data infringes applicable data protection law. Our lead supervisory authority is Integritetsskyddsmyndigheten (IMY), whose details are in section 1. If you live outside Sweden, you may complain to the supervisory authority in your country of residence.
If you wish to exercise any of the rights set out above, please contact us.
No fee usually required
You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive, or excessive. Alternatively, we may refuse to comply with your request in these circumstances.
What we may need from you
We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it.
Time limit to respond
We respond without undue delay and in any case within one month of receiving your request. If a request is complex, or you have made several, we may extend this by up to two further months; we will tell you within the first month and explain why.

We retain personal information only as long as necessary to provide you with our services and offerings, and for our legitimate and essential business purposes, and as set forth in section 8 above.
Sharing personal information
We may disclose any or all of the categories above of your personal information to a third party for a business purpose, as set forth in section 10 above (External Third Parties), and we have done so in the last 12 months. When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. The CCPA prohibits third parties who purchase the personal information we hold from reselling it unless you have received explicit notice and an opportunity to opt-out of further sales.
We disclose your personal information for a business purpose to the following categories of third parties:
- delivery and fulfillment service providers (e.g. UPS).
- third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this Policy.
- any other third parties you have permitted us to disclose your personal information to
- as set forth in this Policy
Your rights and choices
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:
- the categories of personal information we collected about you.
- the categories of sources for the personal information we collected about you.
- our business or commercial purpose for collecting or selling that personal information.
- the categories of third parties with whom we share that personal information.
- the specific pieces of personal information we collected about you (also called a data portability request).
- if we sold or disclosed your personal information for a business purpose, two separate lists disclosing: (a) sales, identifying the personal information categories that each category of recipient purchased; and (b) disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.
Deletion request rights
California residents have the right under the CCPA to request that we delete any of their personal information that we have collected and retained, subject to certain exceptions. Once we receive and confirm a verifiable consumer request (see below), we will delete (and direct our service providers to delete) relevant personal information from our records, unless an exception applies.
We may deny California residents’ deletion request if retaining the information is necessary for us or our service provider(s) to:
- complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with the requesting individual, or otherwise perform our contract with a requesting individual.
- detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
- debug products to identify and repair errors that impair existing intended functionality.
- exercise free speech, ensure the right of another to exercise their free speech rights, or exercise another right provided for by law.
- enable solely internal uses that are reasonably aligned with consumer expectations.
- comply with a legal obligation.
- make other internal and lawful uses of that information that are compatible with the context in which you provided it.
Verifiable consumer request
To exercise the access, data portability, and deletion rights under the CCPA described above, please submit to us a verifiable consumer request as set forth in section 1 above.
Only a California resident, or a person registered with the California Secretary of State that a California resident has authorized to act on their behalf, may make a verifiable consumer request related to their personal information. A California resident may also make a verifiable consumer request on behalf of their minor child.
A verifiable consumer request for access or data portability can only be made twice within a 12-month period. The verifiable consumer request must provide sufficient information that allows us to reasonably verify the California resident, about whom we collected personal information, or an authorized representative, and contain sufficient detail that allows us to properly understand, evaluate, and respond to it. We cannot respond to your request or provide personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.
Making a verifiable consumer request does not require you to create an account on our website. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
We will endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically.
Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Non-discrimination
We will not discriminate against you for exercising any of your CCPA rights. Except as permitted by the CCPA, we will not:
- deny you goods or services.
- charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
- provide you a different level or quality of goods or services.
- suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
